General Terms and Conditions (Terms & Conditions) for the use of services offered by the company Angerer Alpin-+Skischule GmbH.
1. General, scope of application
The company Angerer Alpin-+Skischule GmbH (hereinafter referred to as: “Angerer Ski School”) provides its services based exclusively on the following General Terms and Conditions (Terms & Conditions). These shall apply to all legal relationships between the Angerer Ski School and those who use the services of the Angerer Ski School (hereinafter referred to as “Customer”), even if they are not being expressly referred to. The business purpose of the Angerer Ski School is the operation of an alpine + ski school (ski school). This, in particular, includes services such as the provision of courses to teach skills and impart knowledge of skiing (without guaranteeing any specific training results), as well as guiding and accompanying skiing and snowboarding.
Other business activities of the Angerer Alpine-+ Ski School are the operation of a mountaineering school (summer/winter), mountain guiding activities (summer/winter), high-altitude work including alpine installations.
The currently valid version at the point in time of the conclusion of the contract is authoritative. Deviations from these as well as any other supplementary agreements with the Customer are only valid if they have been confirmed in writing by the Angerer Ski School.
Any Customer terms and conditions are not accepted, even if knowledge of this exists, unless expressly agreed otherwise in writing. The Angerer Ski School expressly objects to the Customer's terms and conditions. No further objection to the Customer's terms and conditions by the Angerer Ski School is required.
To the extent that this contract makes reference to natural persons only in the male gender, such reference applies equally to female and male persons.
The services advertised by the Angerer Ski School do not constitute binding offers, but merely provide the observer with an invitation to submit an offer to the Angerer Ski School.

3. Order and conclusion of contract
The Angerer Ski School advertises its services on their website, www.ski-alpinschule.at, as well as in their business premises. A contract between the Angerer Ski School and the Customer is possible both electronically (submission of an offer via online form and acceptance of the contract by means of e-mail confirmation) as well as on site at the Angerer Ski School’s business premises (contract conclusion by handing over a coupon).
Contract conclusion via the online shop:
The services offered in the Angerer Ski School’s online shop do not constitute legally binding offers, but merely provide the observer with an invitation to submit an offer to the Anger Ski School to conclude a contract.
The submission of a fully completed online form by the Customer represents a legally binding offer to the Angerer Ski School to conclude a contract on the services advertised by the Anger Ski School (in particular the completion of snow sport courses). The Angerer Ski School sends an order confirmation to the Customer on the basis of such an offer. A contractual relationship between the Angerer Ski School and the Customer (contract acceptance) is only concluded upon submission of this order confirmation.
The order confirmation serves as a coupon for the utilization of the booked service and must be presented by the Customer to the respective course instructor at the beginning of the course. The Customer has the option of using an order number to request an order confirmation at the Angerer Ski School’s business premises.
Online offers and online orders:
All services of the ski and snowboarding schools in the region of Salzburg, which are based on online inquiries and orders using the Internet or other online services, are subject to these terms and conditions.
3.1 Content of online offer:
The ski and snowboard school/ski and snowboard rental (hereinafter referred to as “Author") does not guarantee the correctness, completeness or quality of the information provided. Any liability claims against the Author regarding any damages of a pecuniary or non-pecuniary nature caused through the use or non-use of the information presented or as a result of erroneous and incomplete information, are generally excluded, insofar as there is no demonstrable fault of an intentional or grossly negligent nature on the part of the Author.
All offers are subject to change and non-binding. The author expressly reserves the right to temporarily or permanently alter, amend, delete or cease publishing parts of the webpage or the entire offer without separate announcement.
3.2 References and links:
In the case of direct or indirect reference to any and all third-party Internet websites ("Links") which lie outside the responsibility of the Author, liability shall only be assumed if the Author had knowledge of the respective linking of the relevant Internet website’s unlawful contents and if after gaining knowledge he/she grossly and culpably refrained from preventing or denying the use in case of illegal content, provided that this was technically possible and reasonable for the Author.
The Author herewith expressly warrants that at the time the link was integrated, there was no evidence or knowledge of illegal content on the website to be linked. The Author has no influence over the current or future form, content or authorship of the linked or connected websites, and therefore hereby explicitly disassociates itself from all content on all of the linked or connected websites which have been amended subsequent to the link completion or incorporation of the links. This applies to all links and references set on its own website as well as to entries made by third parties in guest books, discussion forums, and mailing lists, etc. set up by the Author.
The operator of the referenced website is solely responsible for illegal, faulty, or incomplete contents, and especially for damages arising from the use or non-use of information presented in this way, and not the party that simply refers to the relevant publication via links.
3.3. Copyright and trademark law:
In all publications, the Author shall strive either to observe the copyright of the graphics, audio and video clips and texts used, to use graphic art, audio and video clips and texts created by himself/herself or to use license-free graphic art, audio and video clips and texts.
All the trademarks and brands named on this website and possibly covered by third-party trademark and brand protection are completely protected by the provisions of the respectively valid trademark law, any other relevant legal standards as well as the property rights of the respective registered proprietor. Just because a brand or registered trademark is named, no assumption shall be made that it is not protected by third-party rights.
The copyright for published material created by the Author himself/herself remains the sole property of the Author of the pages. The reproduction or use of such graphics, sound documents, video sequences and texts in other electronic or printed publications is not permitted without the express consent of the Author.
Contract conclusion at the business premises:
The services offered at the Angerer Ski School’s business premises do not constitute legally binding offers, but merely provide the observer with an invitation to submit an offer to the Anger Ski School to conclude a contract.
A Customer’s declaration to an employee of the Angerer Ski School to use the Angerer Ski School’s services represents a legally binding offer to the Angerer Ski School to conclude a contract. A contractual relationship between the Angerer Ski School and the respective Customer is only concluded upon payment of the desired service and the issuance of a coupon.
In any event, the course card will only be issued once payment of the course costs has been made in full before the beginning of the course.
All prices displayed in the online shop as well as at the business premises of the Angerer Ski School include the respective applicable sales tax.
5. Payment methods
The customer is offered the following methods of payment when paying for the ordered service via the online shop:
We only accept VISA and Master Card and wire transfers. The customer is offered the following methods of payment when paying for the desired service at the Angerer Ski School: We only accept cash payment in euros (EUR), VISA, Master Card and EC/Maestro. Any change must be checked, counted and verified immediately. Complaints made at a later date will not be accepted. In individual cases the total amount of the course costs may be paid in cash directly to the ski instructor or to a person authorized to accept the course fee. In the event of default in payment, Angerer Alpin-+Skischule GmbH may demand statutory default interest from the contracting party.
The exclusive place of jurisdiction is the materially competent district court for St. Johann im Pongau/Austria.
6. Contractual exclusion of set-off and the right of retention
In connection with any legal claims made by the Angerer Ski School, the Customer may only offset such counterclaims which have been judicially ascertained or recognized by the Angerer Ski School, and in the event that the Angerer Ski School becomes insolvent. The option of offsetting with counterclaims which are legally connected to the Angerer Ski School does not exist if the Customer is an entrepreneur within the meaning of § 1 Paragraph 1 Item 1 of the Consumer Protection Act (KSchG).
The Customer's rights of retention are not affected.
7. Data privacy
The Customer hereby agrees that personal data, including first name, last name, date of birth, home address, language, e-mail address, telephone number and credit card data, which he/she submits to the Angerer Ski School in the context of ordering services, shall be processed and saved by the Angerer Ski School for processing and implementing the contractual relationship between the Angerer Ski School and the Customer and then sent to the service provider.
8. Customer cancellation
The Customer is entitled to withdraw from the concluded contract at any time in exchange for the payment of the following cancellation costs.
In order to exercise the right of withdrawal (cancellation), the Customer must submit a notice of cancellation by post, fax or e-mail to the following address/fax number or contact the Angerer Ski School by telephone:

In case of cancellation by the Customer, the Angerer Ski School is entitled to charge the following cancellation fees:
Up to 14 days prior to the beginning of the booked service: none
As of 14 days prior to the beginning of the booked service: 30% of the stipulated total price (also applies to the non-utilization of the booked service)
The above-mentioned deadlines also apply in case of partial cancellation of the booked service. The date on which the Angerer Ski School receives the notification of cancellation shall be decisive.
Should no cancellation be carried out three days prior to the starting date, 100% of the total booking price shall be charged. (This also applies to non-utilization of the booked service.)
For booked group courses: in the event of illness or accident, which makes it impossible to participate in the booked service, a reimbursement of the paid fee is also possible within the last 14 days before the start of the booked service, if the Customer of the Angerer Ski School provides a medical certificate. Should the journey to Gastein have already taken place, a medical certificate from a local physician must be submitted.
If a portion of the booked service has already been used, the fees shall be recalculated for the service already used in accordance with the course fees. The portion of the amount already paid,
which exceeds the fee calculated in this way, shall be reimbursed.
In the case of legitimate cancellation, the refund shall be issued within 14 days of the date of cancellation.
9. Cancellation by the Angerer Ski School
Should the weather conditions prevent the booked service from being carried out due to safety reasons, the Angerer Ski School is entitled to postpone or cancel the booked service. In the case of the cancellation of the booked service, the Angerer Ski School is obliged to reimburse the Customer with the fee paid for the booked service within 14 days from the date of the cancellation.
Course participants are expressly advised that according to the Salzburger Landessportgesetz 1988 (Salzburg Regional Sports Law), LGBI No. 98/1987, children and adolescents up to the age of 15 years
are required to use a ski and snowboard helmet which meets the requirements of the ÖNORMEN 1077: 2007 provision for skiing and snowboarding. The course participants must also know the content and the application of the current Federation Internationale de Skis slope rules and adhere to them.
11. Accident insurance
The Customer acknowledges that going skiing is associated with numerous dangers and, in particular, in the case of skiing on open terrain, there is the possibility that the Customer could find themselves in an emergency situation on the mountain. The Customer further notes that rescuing a person who finds themselves in an emergency situation on the mountain is associated with high costs, especially in the case of air and mountain rescue. The Customer is advised to take out appropriate insurance for leisure activities (in particular to compensate for mountain rescue and air rescue costs), especially since the Angerer Ski School is not liable for such rescue and flight rescue costs, unless the Angerer Ski School caused these rescue and/or flight rescue costs through intentional or grossly negligent conduct on behalf of the Angerer Ski School, their legal representatives or vicarious agents.
12. Skill groups
The services provided by the Angerer Ski School are divided into the following skill groups:
Adult group (18 years and up): Trips on slopes, ski routes, variety runs, ski tours, rides on open terrain
Youth groups (13 to 18 years): Trips on slopes, ski routes and rides on open terrain
Children’s groups (up to 12 years): Skiing/snowboarding on slopes and ski runs only
The Angerer Ski School is responsible for assigning ski lesson groups. After a lesson has begun, the Customer must also accept changes to the group assignment, in particular being assigned by the Angerer Ski to a less advanced skill group. If the number of group participants is reduced to less than four persons in a group lesson, the Angerer Ski School retains the right to combine groups or to reduce the number of instruction hours accordingly.
The Customer must abide by the instructions given by the Angerer Ski School, their legal representatives and vicarious agents. Disregard for a warning entitles the Angerer Ski School to immediately terminate the contract. The participation in services offered by the Angerer Ski School of Customers who are under the influence of alcohol or drugs also entitles the Angerer Ski School to immediately terminate the contract.
In the aforementioned cases, the Customer is not entitled to a refund of the paid fee.
The Angerer Ski School is obligated to guarantee the Customer that the service booked meets the conditions of the contract, however without guaranteeing the Customer any results in any form.
Except for in the case of personal injury, the Angerer Ski School is not liable for damages insofar that the damage was not caused by an intentional or grossly negligent conduct of the Angerer Ski School, its legal representatives or vicarious agents, and the harmful behavior does not affect the principal obligations agreed upon in the contract with the Angerer Ski School. This exclusion of liability does not apply in the case of atypical or unforeseeable damages which the Customer could not foresee.
The Angerer Ski School, in particular, does not accept liability for damages, which the Customer inflicts upon him/herself or other persons while executing the agreed service.
The Angerer Ski School only carries out its services outside, on ski slopes or on open terrain, sometimes under difficult to very difficult conditions. Unfavorable weather conditions such as rain, snow or fog can make the conditions even more difficult.
The Customer must truthfully and comprehensively inform the Angerer Ski School about his/her abilities and experiences in relation to snow sports. The Customer must also inform the Angerer Ski School about his/her physical abilities, in particular his/her state of health and any illnesses.
The services provided by the Angerer Ski School can be very demanding on the Customer’s equipment as well as on their physical fitness and skiing technique. Each Customer is therefore requested to carry out the booked services using sporting equipment and mandatory safety equipment which is in perfect condition as well as to realistically assess his/her own abilities.
The Customer is advised that if he/she is not wearing a helmet in case of injury this can constitute contributory negligence on his/her part. As a result, the Customer is advised to wear a helmet as well as the other safety equipment recommended for carrying out the booked activity (for example, avalanche beacon in open terrain).
The contractual partner must make any complaints and grievances immediately with the respective office of the ski and snowboard school in the Salzburg region in order for them to be quickly remedied
so that the service can continue to be carried out. Should the contractual partner not exercise his/her right to make a complaint immediately, or in any case not by the time the service has been fully completed, then any claims for reduction of the fee cannot be considered. Any other claims against the ski and snowboard schools in the Salzburg region must be made in writing and justified at the latest four weeks after the grounds for the claim arises or obtaining knowledge thereof.
16. Place of performance
The headquarters of the Angerer Alpin-+Skischule GmbH is the place of performance for deliveries, services and payments.
17. Governing law
As agreed, Austrian law shall apply exclusively, with the exception of the relevant provisions on the Conflict of Laws.
The court of jurisdiction is exclusively the District Court of St. Johann im Pongau, Austria.
The contractual language is German.
18. Data Protection
The customer agrees that the personal data provided by the customer, namely first name, surname, date of birth, residential address, language, e-mail address, telephone number and credit card data, may be processed and stored by Alpin-+Skischule GmbH for the execution and carrying out of the contract between the Angerer Alpin-+Skischule GmbH and the customer, and that the data may not be passed on to any third parties.
